HJBPhotography Wedding Agreement

Please read through and fill out this form to finalise your booking with HJBP. 

HJBPHOTOGRAPHY AGREEMENT - Under these terms & conditions "HJBP" shall mean HJBPhotography. "The client" is to be the named bride and groom as set out on the wedding booking. Any changes to the terms and conditions detailed within this contract must be set out and agreed upon by both parties in writing. This agreement shall be governed in accordance with the laws of England and Wales. This is a legal and binding document.

Payment Policy and Expenses - The total cost for the event service is outlined on the invoice. A non-refundable retainer of £200, along with this signed contract, reserves full coverage on the specified date and location. This retainer will be deducted from the final balance, and the remaining balance must be paid by the client no later than 30 days before the agreed wedding date. The client has a 14-day cooling-off period starting from the retainer payment date. If the client wishes to cancel within this period, a full refund will be provided. Travel expenses will be incurred for events outside 30 miles of Tondu, South Wales, as calculated using www.distantias.com. The client agrees to pay the agreed-upon travel fee, covering petrol, hotel, and miscellaneous expenses outlined in this contract.

Cancellation - Should the wedding be cancelled within 60 days of the wedding date, the full balance is still required. Clients can cancel this contract anytime by notifying HJBP via email. If weddings are postponed or rescheduled, the retainer is retained if HJBP is available on the new date. If payment isn't made as specified, HJBP can cancel the agreement, retain any paid monies, and not attend the event. If the client cancels before the wedding, the second payment is refunded only if HJBP can rebook the date. HJBP can refuse services/products due to non-payment.

Emergencies, Force Majeure or Act of God - This contract can be altered or cancelled due to factors beyond the client's or photographer's control. If the photographer can't fulfil agreed services due to uncontrollable circumstances, liability is limited to a full refund. The client must promptly contact HJBP, who will try to arrange an Associate Shooter and edit the pictures if possible. HJBP is not responsible for personal accidents during a shoot. In case of defects, HJBP's liability is limited to fixing the issue. They are not liable for claims due to work delays or image transit issues.

If the Photographer can't fulfil duties, they won't be responsible for further issues, loss/damage of photos, or delivery problems. HJBP will strive to recover lost photos; if only a part is lost, the refund will be a percentage of the total, not exceeding the total paid. In case of cancellation due to emergencies within six months of the wedding, HJBP retains the retainer but refunds the remaining balance. Both parties must provide written documentation and an excuse signed by a professional. Immediate family is defined as parents, stepparents, siblings, spouse, and children. This clause can be invoked up to the wedding day by either party.

Wedding Details - A timeline of the wedding day, including dates, times and locations will be agreed by email 14days prior to the wedding date to ensure the HJBP has an agreed plan for services required.

Coverage and Cooperation - HJBP and the client will coordinate the wedding day arrival time in advance. Coverage hours, including setup, tear-down, and breaks, are consecutive from HJBP's arrival. The client identifies important individuals for photos, and HJBP uses professional discretion for other shots. While HJBP strives for the best, clients acknowledge the unpredictable nature of photojournalism, waiving the right to civil action for missed moments. HJBP isn't liable for uncontrollable circumstances. Lists of requested photos are for organisation; due to various factors, not all may be possible. All other photos are taken at HJBP's professional discretion.

HJBP's movements during ceremonies may be restricted and isn't responsible for obstructed views. Guaranteeing everyone is photographed isn't assured; focus is on the bride, groom, and the events surrounding.

HJBP can refuse images conflicting with their style or inappropriate content, ensuring satisfaction within professional standards.

Additional Hour/s of Coverage - If required, HJBP will include the additional coverage time when establishing arrival and departure times with the client prior to the wedding date. Additional hours must be consecutive with the block of hours already included with the package i.e 10:30am - 7:00pm. Each additional hour will incur a cost of £100.

Attendance - If the photographer is unable to attend the wedding due to unforeseen circumstances, they will appoint another competent photographer or assist the client in hiring one. If a replacement can't be found and the agreement can't be fulfilled, HJBP will refund all money received, minus expenses or completed work. HJBP is not responsible for further issues, including loss/damage of photos. Refunds for lost photos are based on the percentage of the total. The only remedy for claims is a refund, not exceeding the total amount paid under this Agreement before the issue arises.

Providing Meals - HJBP is generally on the same schedule as the bride and groom, the client agrees to provide HJBP with one meal during the time that the client is served at the reception. If this meal is provided out of view of the reception activities, HJBP cannot guarantee events occurring during the photographers absence will be captured. This meal does not need to be part of the wedding breakfast, some venues provide a “photographer’s lunch” at their bar. If a meal cannot be provided the client must let HJBP know as soon as possible so that HJBP can make other arrangements.

Responsibilities - HJBP is the exclusive photographer for the wedding, prohibiting unauthorised professional photography. Guests can take photos but are asked not to interfere with HJBP's duties (standing in front of or behind the photographer), or photograph arranged poses. Guests are requested to avoid using flash during specific time. Prior to the wedding, it is recommended to politely request guests not to take photos during the ceremony. HJBP is not responsible for coverage issues due to uncontrollable factors. While they strive in editing, they are not liable for wardrobe malfunctions. HJBP may decline equipment use in adverse conditions. They are not responsible for existing backgrounds or poor lighting. Communication of schedule or location changes is vital, and confirmed via email. The client agrees to confirm the schedule one week before the event.

HJBP is responsible for securing permission from the venue owner/operator for use of the production venue and allowing HJBP to set up all necessary production equipment. 

Editing / Retouching - The Client should be aware that editing of the photographs is a lengthy process and agrees to wait up to 6 weeks for their final product - HJBP endeavours to hand the finished gallery over to clients as quickly as possible, but prides itself on quality over speed. Requests for quicker delivery (which is reasonably shorter than the specified wait), made 14 days before the wedding, incur a 30% charge. Failing to inform HJBP may result in no guarantee that a finished product will be provided before the 6 week deadline.

Clients acknowledge HJBP's artistic discretion in creating and editing photographs. Images determined by HJBP to be substandard or duplicated may be edited out. HJBP will use their professional judgment and sole discretion to select which photos to deliver. The completed gallery is final. Additional requested alterations incur a pro-rated rate of £80 a day, with limited colour correction and retouching at the Photographer's discretion.

Gallery Delivery - Images are delivered through a secure online gallery and, in some cases, high-quality JPEGs on a USB; raw files won't be provided. Clients are responsible for safeguarding the photos. HJBP isn't responsible for digital media lifespan or future technology changes. Report link/USB issues within 30 days for a free replacement; after 30 days, a £100 fee applies.

The gallery includes print options and album templates for approval. As albums reflect HJBP’s art, the photographer maintains final approval. Clients must complete album proofing within 30 days of receiving the link. Once the change has been approved, it will then be submitted to the publisher.  HJBP isn't responsible for printing delays. Unordered or unapproved products and unshot sessions expire six months after the wedding. HJBP exclusively works with the wedding couple for ordering, proofing, and shipping final products.

HJBP is not responsible for prints not ordered directly from HJBP. For best results, print through HJBPs online cart. Clients agree not to scan, copy, or alter images without permission. A £100 usage fee per image applies if unauthorised reproduction is detected. Purchasing high-resolution files includes a release for personal use within one household, prohibiting alterations, sale, gifting, or publication.

Copyright - HJBP retains the rights to all images produced as part of his photography services. The client permits HJBP to use them for promotion without restrictions. HJBP is not responsible for misuse by others. HJBP can grant third-party use, and any compensation or credit for the images belongs to HJBP.

Authorship Credit - Authorship credit in the name of HJBPhotography with a link to HJBPs domain ( www.hjbphotography.com ) must accompany any images posted or displayed on any social media.

Timeline and Package Delivery - The following are approximate dates and may be subject to change due to high-volume weekends.

BOOKING - Non-refundable retainer received by HJBP and HJBPhotogrphy Agreement signed by all parties.

60 DAYS BEFORE THE WEDDING - Any cancellations from this point on are now subject to full payment.

30 DAYS BEFORE THE WEDDING - Any remaining balance is due and final arrangements must be made

THE WEDDING DAY - Time to relax, and enjoy your day with family and friends.

6 WEEKS AFTER THE WEDDING - Photographer will email a link for online gallery and album preperation.
